Instruction of revocation

You may revoke your declaration of contract within 14 days in written form (e.g. letter, fax, email) without indication of reasons or by return of the item.

The time period begins at the earliest upon receipt of the goods. To keep the term the punctual dispatch of the revocation (or the item) will suffice. The revocation has to be sent to the address figuring on the letter of confirmation for your order.

Revocation consequences

In case of an effective revocation, received services on both sides must be refunded (e.g. interests). If you can not refund the received services to us entirely or partly or only in worsened condition you must provide a replacement of the same value if necessary. This does not apply for the surrender of goods if the deterioration of the item can solely be traced back to its examination, like it would be possible for a customer in a shop. Furthermore you can avoid indemnity for a caused damage by not treating the items like your property and by avoiding everything that impairs their value.

In case of a return of items whose value is up to 40 euros you will have to meet the costs of the return if the received items correspond to the ones you ordered. If that is not the case, the return remains free. Items that can not be shipped by parcel will be collected by us.

Special Indication

Your right of revocation expires early if your trade partner has started the execution of the services before the end of the revocation deadline with your explicit consent, or if you arranged it yourself (e.g. downloads etc.)

Terms and Conditions of Sale

Orders are accepted exclusively on the basis of the following conditions. These are only effective if confirmed by us in writing. Rules that depart from these conditions must be stated in writing. Client counter confirmations, making reference to his/her business terms and conditions are herewith contradicted.

Drawings and designs remain our intellectual property. If we are not given an order we will charge the costs of manufacture. We can not warrant adherence to the delivery date. Any claims for damages caused by delayed delivery are excluded. We reserve the right to cancel accepted orders if there is no possibility of delivery. Within events of force majeure , e.g. war, deficiency in raw material, obstruction of traffic routes or production disturbances, we are entitled to withdraw from the contract.

Excess or short delivery and deviations of the compositions of raw materials up to 10% are deemed customary.

Changes and improvements of the method of production or of the colour tones that do not affect the value of the item are left up to us. Deviations in the colour tone are unavoidable and can not be a reason for reclamation, as well as slight scratches or paintwork defects that do not considerably impair the general appearance.

Color pressures on original materials are obligatory only in the context of the technical possibilities.

The product remains our property until full and complete payment has been made, even in the cases when the product has already been used or when it has been transferred into the hands of a third party. Any claims arising as a result of the resale are effectively assigned to us.

In case of a delay in payment, default charges in the amount of 2% above the actual bank rate are billed.

The client is personally liable if by execution of his orders third-party rights, notably copyrights, are violated.

Every objection must be made in written form within a period of 8 days upon receipt of the product. We reserve the right to either take back the defective goods or to deliver replacement parts. If the delivery of a completed product is of an incorrect quantity, we must be notified upon receipt of the first delivery.

Any disputed arising hereunder will be settler before a competent Berlin court of law.

Any other contractual agreements are valid if and only we expressly notify the client in writing.

We use only first class industrial paints and varnishes. We are not held liable for imperfections which may arise due to the paints and varnishes.

Product Warranty

The new Product Warranty Directive taking effect the 1st January 2002, which extends the length of warranty to 24 months, can not be applied for defects in our products that occur during the outdoor use, e.g. bleaching of colours, rust or mishandling.

We do not take back packaging. The costs for the disposal of packaging are already considered in our fees.
